Plan the numbers before the first deposition, then keep one log for the case.

A planning worksheet, not legal advice. The order, rule, or stipulation in your matter decides the numbering.

      The three schemes.

      • Running series, by stipulation. One running series for the case, as the parties agree. Each deposition starts after the last number used. No order cited: in a two-party case, numbering is usually a matter of habit and stipulation.
      • Per-deponent prefix. Each deposition starts again at its first number, prefixed with the deponent’s name. The Target data breach MDL order: numbered within each deposition, prefixed with the deponent’s name.
      • Number blocks per deposition. Each deposition gets its own block of numbers, and no two blocks overlap. The Zantac and Valsartan orders: the court reporter assigns a block per deposition, with no overlapping numbers.

Whichever scheme applies, the log is the same job: every number has one document. Where an order keeps a marked exhibit’s number for the rest of the case, as the Zantac and Valsartan orders do, the “Previously marked as” column is there for that check.
